Online store terms and conditions

SIA „Sudrablīnis” (SUDRABLĪNIS), registration certificate no. 40003493082, registered address: A.Dombrovska iela 23, Rīga, LV1015, hereinafter – the online store – provides the content available on the website and provides goods / services in accordance with the Terms and Conditions set out below.

  1. Definitions

1.1. Terms – Terms of purchase and sale of goods (distance contract), which determine the procedure for remote (distance) buying and selling carried out in the sudrablinis.lv online store, the obligations and rights of the Seller and the Buyer, the terms of purchase and payment of the Goods offered by the Seller, the procedure for the delivery and return of the Goods , the responsibility of the parties, as well as other issues related to the purchase and sale of Goods.

1.2. sudrablinis.lv – Seller’s online store (https://sudrablinis.lv/) To conclude the transaction.

1.3. Regulations of the Cabinet of Ministers – Regulations of the Cabinet of Ministers of May 20, 2014 No. 255 “Terms on the distance contract”, which are applicable if the Buyer as a Consumer uses the sudrablinis.lv online store to purchase the Goods offered by the Seller.

1.4. Transaction – a contract between the Buyer and the Seller for the purchase of the Product concluded in absentia, using means of distance communication.

1.6. Buyer – a natural person who has reached the age of 18, or a natural person who performs economic activity, or a legal person who concludes the Transaction based on the Terms. At the time of receiving the Product, the Buyer must present the confirmation received by e-mail or telephone to the Seller, confirming that the Product is ready for delivery, and/or present the Order number.

1.7. Parties – Buyer and Seller together.

1.8. Profile – User profile created by the Buyer to perform a Transaction in the sudrablinis.lv online store, which stores the history of the Transactions concluded by the Buyer, including information on orders placed, contact information, delivery address and other information/data entered/specified by the Buyer.

1.9. Consumer – Buyer – a natural person who expresses a desire to purchase, purchases or could purchase or use the Product and Delivery Services for a purpose that is not related to the economic or professional activity of the natural person.

1.10. Product – product that the Seller offers for sale in the sudrablinis.lv online store at the price determined by the Seller. Product prices in the sudrablinis.lv online store are indicated in euros (EUR) with value added tax (VAT). The indicated prices for the Goods do not include the costs of the Delivery service. Receiving the goods at the Seller’s customer service center – warehouse is free of charge.

1.11. Delivery service – a service, as a result of which the right to the Product is transferred to the Buyer at his own expense, and which the Seller offers to the Buyer in the sudrablinis.lv online store at prices determined by the Seller.

1.12. Order – an offer expressed by the Buyer to purchase the Product and Delivery service from the Seller in the amount specified by the Buyer.

1.13. Shopping cart – the list of Products and Delivery services selected by the Buyer for purchase in the sudrablinis.lv online supermarket.

1.14. Order number – the number assigned to the Buyer’s Order.

  1. General Provisions

If the consumer purchases goods through the website, then such mutual agreement is considered a Distance Contract and is subject to the legal provisions of the Republic of Latvia governing the distance contract, including, but not limited to, the Consumer Rights Protection Law of the Republic of Latvia, Cabinet Regulations on Distance Contract etc.

  1. Making a Purchase

The prices and specifications of the products sold in the online store are indicated next to the products. To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Make a payment to complete the order.

  1. Terms of Payment

The payment currency on the site is euro. The purchase can be paid for by choosing the payment methods provided by the payment platform LUMINOR.

Personal data required for making payments is transferred to the licensed payment bank LUMINOR.

The contract enters into force upon successful payment to the online store’s bank account. If for any reason it is not possible to fulfil the order, the Buyer will be notified accordingly, and the amount paid will be refunded as soon as possible, but not later than within 14 days after the receipt of the notification.

If the Buyer has concluded a contract using the distance purchase-sale procedure and has received the Seller’s invoice, the Buyer can receive the goods no later than 14 days after payment of the received invoice.

  1. Delivery Terms

The order is fully accepted, processed, confirmed and prepared only after we have received confirmation that payment has been made.

We will send a confirmation that we have received the order, order information and order number to the provided e-mail. Check all the details of the order and if any of them is inaccurate, contact us immediately by e-mail info@sudrablinis.lv

If you do not receive an order confirmation within the next 12 hours, please contact us so that we can work together to clarify and resolve the situation.

If we cannot reach you by phone during your selected delivery time or you do not open the door for us, the order will be returned to the SUDRABLNIS warehouse, where you will be able to pick it up within the next 24 hours on weekdays from 09.00-16.00 or by contacting us again for a repeated delivery attempt by writing us to info@sudrablinis.lv.

You will have to pay 10 (ten) EUR for the repeated delivery.

If we do not receive any message from the buyer within the next 24 hours, the order will be cancelled, but the order amount will not be returned.

The delivery fee will be calculated after entering the address and postal code.

The Buyer is fully responsible for the accuracy of the data provided and confirmed by them during the ordering process, as well as for creating the conditions for the delivery and receipt of the order. The Seller shall not be liable for the consequences and has the right to claim damages from the Buyer if the Buyer has not provided accurate data or has not confirmed them correctly, or the Buyer does not accept the ordered products at the specified place of delivery.

You may return the order within 1 (one) business day and replace the products if:

  1. Allergens

SUDRABLĪNIS reminds that the product may contain various allergens. You can get more detailed information about the presence of specific allergens in the product on the SUDRABLĪNIS website next to each product description or by contacting the SUDRABLĪNIS administration.

SUDRABLĪNIS shall not return money for the order and shall not replace the order, if the customer has not considered its ingredients and received a product, which contains ingredients that causes allergies to the customer.

  1. Storage conditions

In order to prevent damage to the SUDRABLĪNIS products and protect it from contamination, the PRODUCT STORAGE CONDITIONS must be strictly observed:

Failure to comply with any of the above requirements, or partial compliance with them, may affect the quality and shelf life of the product. SUDRABLĪNIS is not responsible for the quality, freshness and shelf life of the product if any of these terms have not been complied with.

  1. Right of Withdrawal

The 14-day right of withdrawal does not apply to foodstuffs, beverages or other goods intended for immediate household consumption.

The Buyer bears the cost of returning the goods, unless the reason for the return is that the goods do not correspond to the order (for example, the wrong product or damaged product).

The Buyer is obliged to return the goods to the Seller without delay, but not later than within 14 days after sending the withdrawal form to the online store. Upon receipt of the returned goods, the online store shall immediately, but not later than within 14 days, refund all payments received from the Buyer on the basis of the Distance Contract.

The Seller has the right to withhold payment until he has received the goods or the confirmation of return of the goods from the Buyer. If the Buyer has chosen a different shipping method than the cheapest shipping method offered in the online store, the online store is not obliged to compensate for the excess shipping costs.

The online store shall not be liable for any delay or non-fulfilment of obligations, or any other type of non-fulfilment due to circumstances and obstacles beyond the reasonable control of the online store.

If the Buyer/Consumer chooses to send the delivery by courier, then the Buyer assumes all the risks associated with it (failed delivery, delivery delay, non-compliance with the temperature regime, etc.). The seller may (at its discretion) place cooling elements in the shipment, but does not assume the risk if the product is damaged during transportation. With complaints, the recipient addresses the courier service. The seller, at his discretion, can help solve the situation, give the buyer all the shipping information.

The online store reserves the right to refuse to sell the goods and request the return of the goods from the Buyer, if the price indicated in the online store is significantly lower than its market price due to an error.

  1. Consumer Rights Regarding Defective Goods

The online store is not responsible for defects that have occurred after delivery of the goods to the Buyer. If the purchased goods have defects (incorrect assortment, damaged packaging), for which the Seller is responsible, the Buyer has the right to request the elimination of defects or exchange for new goods free of charge upon receipt of the order before signing the goods handover statement.

The Seller shall provide a written response to the consumer’s complaint within 30 working days.

Buyers can make claims about the quality of the product only if they can present a temperature printout during the entire transportation and storage period since the delivery or receipt of the product at the Seller’s warehouse. The seller examines only those claims that have been submitted before the expiration date of the specific product, presenting a receipt or other proof of purchase document. The Buyer is obliged to send the damaged item back to the Seller for examination/analysis at his own expense. If it is found that the product is damaged due to the fault of the Seller, both the value of the product and the transport are compensated

  1. Buyer’s Personal Data Processing

The online store processes only the personal data that the Buyer has entered when ordering goods, such as name, surname, e-mail, etc.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may from time to time contact you by sending you information about our services and the latest offers. For this purpose, we may process the e-mail address you provided when signing up for marketing communications. The Buyer has the opportunity to opt out of marketing communications by notifying us by writing to info@expressgourmet.lv

  1. Dispute Settlement Procedures

In matters not stipulated in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

The Parties shall resolve all disputes between the Seller and the Buyer by mutual negotiations or correspondence. If the dispute is not resolved in the form of negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, observing the regulatory enactments of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The Buyer also has the right to apply to the European Union dispute resolution bodies.
